What does a divorce cost in South Africa?

Where the money goes in a South African divorce, why a contested divorce costs so much more than an agreed one, and practical ways to keep legal fees down.

There is no single price for a divorce in South Africa. The cost depends far less on what you own than on how much you disagree about. An agreed divorce with one lawyer is a fraction of the cost of a contested one, where each spouse pays their own legal team for every step until a court decides.

Where the money goes

  • Lawyers. Attorneys usually charge by the hour or a fixed fee for an uncontested divorce. In a contested High Court matter there may also be an advocate.
  • Court and sheriff. Issuing the summons and having the sheriff serve it. These are modest next to legal fees.
  • Valuations. Property, a business or a pension may need a professional valuation, especially if you don't agree on what it's worth.
  • Experts in disputes about children. If care and contact are contested, reports from psychologists or social workers can add significantly. The Family Advocate's office itself doesn't charge.
  • Moving property. Conveyancing to transfer the home, and bond registration or cancellation. A transfer between spouses under a divorce order is generally exempt from transfer duty, but the attorneys' fees still apply.

Why contested divorces cost so much more

A contested divorce runs through pleadings, requests for documents, pre-trial meetings, negotiations and possibly a trial. Each step is billable time, for two legal teams. It also stretches over months or years, and the court can order one spouse to pay some of the other's costs. The money comes out of the same family estate you're trying to divide, so the longer you fight, the less is left for either of you.

How to keep the cost down

  1. Agree what you can, early. Every item you settle between you is one a lawyer doesn't have to argue.
  2. Disclose everything up front. A full, honest list of assets, debts and income avoids expensive requests for documents later, and builds trust.
  3. Share one lawyer while you agree. A single lawyer reviewing an agreed settlement costs far less than two lawyers negotiating.
  4. Separate the hard item from the rest. If one thing is disputed, agree everything else so only that item is contested.
  5. Get valuations you both trust. Agreeing on one valuer is cheaper than duelling experts.

What Agreeably costs

Agreeably charges one fee per divorce, chosen when you ask for a lawyer review, and either spouse can pay it. See the packages and prices. While nothing is contested you share one lawyer. Agreeably also shows a running estimate of legal fees, so you can see what contesting an item would cost before you do.

This guide is general information about South African law, not legal advice for your situation. Agreeably is a settlement facilitator, not a law firm: before you sign, a lawyer should review your settlement agreement.
